Terms of Service

Last updated: October 7, 2026

These terms cover your use of dreamberrynyc.com and anything you buy from us. Please read them before you order — placing an order means you accept them.

We are DreamBerry NYC LLC, a limited liability company based in New York. Throughout this page, "we", "us" and "our" mean DreamBerry NYC LLC, and "you" means you.

What we make

Every DreamBerry NYC piece is designed and hand-finished by us in New York. Most are one of a kind, and even within a single design no two are identical — bead placement, glitter, cream-glue texture and colour will vary slightly from piece to piece. That variation is a property of handmade work, not a fault. It does not cover material departures from the listing, defective workmanship, missing features, or an item that is unsafe: those are faults, and the remedies in our Shipping & Returns policy apply.

Product photographs show the actual item or a representative example of the design. Colour reproduction varies between screens, so shades may differ a little from what you see.

Our products are intended for teenagers and adults and are not intended for children twelve or under. Many contain small parts and are not toys. Please review the safety information and warnings provided with each product before use. Additional safety information is available on our Safety page.

Our products are independently designed and created by us. DreamBerry NYC is not affiliated with or endorsed by any third-party brand, artist or entertainment company. Where a product is designed to hold a card, photo or similar item, that item is not included unless the listing says so.

Your account

You need a DreamBerry NYC account to place an order. Keep your sign-in details secure, and tell us promptly at hello@dreamberrynyc.com if you think someone else has used your account. You are responsible for activity you authorize under your account and for taking reasonable steps to keep your sign-in details secure. You are not responsible for activity that results from a failure on our side, and nothing here limits any right you have concerning an unauthorized payment.

Closing your account does not affect an order you have already placed, or any refund you are owed. You can still contact us at hello@dreamberrynyc.com about a past order after your account is closed.

Keep your email address current — it is how we send your order confirmation, tracking, and any message about a problem with your order.

Age. You must be at least 13 to create an account. If the purchaser is under 18, an adult must place the order and accept these terms using their own account; that adult is the customer for the order. We do not verify age at checkout, so this is a condition we ask you to meet rather than something the site checks. If you are under 13, please do not create an account or send us any personal information.

Prices and payment

Prices are shown in US dollars and are exclusive of shipping, which is calculated at checkout from the actual weight and dimensions of your order.

Applicable sales tax is calculated at checkout based on the items purchased, the delivery address, and applicable state and local tax laws. Where DreamBerry NYC LLC is required to collect sales tax, it will be included in your order total before payment.

We accept PayPal. Your payment is processed by PayPal under their own terms; we never see or store your card details.

Prices may change at any time, but a change never affects an order you have already placed.

Orders we cannot fulfill

When your order is accepted. We take payment when you place the order, and the confirmation email you receive at that point means the order is accepted — not merely received. The exception is the check we run immediately before taking payment, for pieces that may have sold elsewhere; if that check fails, no payment is taken and the order does not go through.

We may decline or cancel an order before it ships — where the item is no longer available, where a material price or listing error prevents us from fulfilling the order as agreed, where we are unable to ship to the address given, or where we have reasonable grounds to believe the order is fraudulent. If we cancel, we promptly refund you in full, including any shipping you paid, and we tell you why. This does not limit any remedy you have under applicable law.

We do not decline orders on the basis of any characteristic protected by law.

Because most of our pieces are one of a kind and some are also listed elsewhere, an item can sell between your order and our packing it. If that happens we will tell you and refund you in full.

Cancelling an order

You can cancel your own order up until it is packed and marked ready for drop-off. After that the parcel is labelled and leaving our hands, and the self-service option is no longer available. Creating a shipping label is not the same as the parcel being shipped, and it does not remove any cancellation or refund right you have by law — including where a shipment is delayed beyond the time we advertised. If you need to cancel after that point, email us and we will tell you where the order is and what we can do.

Cancelling refunds the full amount you paid, including shipping, to the original payment method you paid with. We initiate refunds on the timetable set out in our Shipping & Returns policy; payment-provider processing does not extend any deadline that applies to us by law.

Shipping, delivery and returns

Shipping, delivery timescales, cancellations, damaged or missing parcels and returns are covered in full on our Shipping & Returns page, which forms part of these terms.

Our Privacy Policy explains how we handle personal information. Our Safety information and Product Care guidance explain safe use and care of our products. Those pages do not waive or reduce your legal rights or the remedies promised in these terms and our Shipping & Returns policy.

In short: we ship within the United States by USPS, we do not accept returns for change of mind, and we refund you in full if something arrives damaged, incorrect or not as described.

If these terms and one of those pages disagree, the more specific page governs its own subject — Shipping & Returns for shipping, cancellations, refunds and returns; the Privacy Policy for how we handle information; Safety and Product Care for how to use and look after a piece. Where the conflict is about your rights as a customer, whichever gives you more applies. All of these pages are linked from the footer of every page and are available to read before you buy.

Our designs and this site

The original photographs, artwork, text, and designs created by DreamBerry NYC are owned by DreamBerry NYC LLC. Where a piece incorporates material created by someone else, we claim no ownership of it. Third-party trademarks, characters, and other intellectual property remain the property of their respective owners.

You are welcome to browse, shop, and share links to our pages in the ordinary way. Please do not scrape, copy or systematically collect content from this site, or use it to train a model, without our written permission, and do not interfere with how the site runs or try to access parts of it you are not meant to.

Using this site

Please do not use the site to break the law, to interfere with how it runs, to gain access to another person's account, or to place orders you do not intend to pay for. We may suspend or close an account used that way, as described under Misuse of these policies on our Shipping & Returns page.

If something goes wrong

We stand behind what we make. If an item arrives damaged, incorrect or not as described, tell us and we will put it right — that process is set out on the Shipping & Returns page, and nothing in these terms limits it.

Beyond that, this website — its availability, and the general information on it — is provided as it is. We do not promise the site will always be available or free of errors. That does not apply to the things we sell: what we say about a product in its listing, and the remedies in our Shipping & Returns policy, stand.

To the fullest extent permitted by applicable law, DreamBerry NYC LLC will not be liable for indirect, incidental, special, or consequential damages arising from use of this website or purchases made through it.

Our aggregate liability for ordinary contractual claims relating to an order will not exceed the amount paid for that order, to the extent permitted by law.

Nothing in these terms excludes or limits liability for personal injury, property damage, fraud, intentional misconduct, gross negligence, or any other liability that cannot lawfully be excluded or limited. Nor does it reduce the refunds and remedies we promise in our Shipping & Returns policy. That includes your rights under PayPal's Purchase Protection and under consumer protection law.

Changes to these terms

We may update these terms. The version that applies to your order is the one published when you placed it, and the date at the top tells you when this version took effect. The same applies to our Shipping & Returns policy: the versions in force when you paid govern your order. We keep dated copies and will supply the version that applied to your order on request. A later change never reduces rights on an order already placed, and where a change materially affects an open account we will tell you rather than rely on the posted date alone. Changes to how we handle personal information are explained in our Privacy Policy. We may update safety and care guidance to communicate new information without reducing your existing rights.

Governing law

These terms are governed by the laws of the State of New York. Any dispute will be brought in the state courts of New York or federal courts located in New York that have jurisdiction, and we each agree to those courts hearing it. None of that takes away a right you have under consumer protection law to bring a claim where you live, or any other right that cannot be signed away.

If part of these terms does not hold

If any part of these terms turns out to be unenforceable, the rest still applies, and that part is treated as limited only so far as necessary. If we do not enforce something straight away, that is not a waiver of it — we can still enforce it later.
